1. Scope
The current version of these terms and conditions, which can be accessed at www.vf-feintechnik.de, applies exclusively between the customer and VF-Feintechnik GmbH. The customer recognizes this with the order. Counter-confirmations by the buyer with reference to his business or purchase conditions are contradicted. Deviations from these terms and conditions are only effective if the seller confirms them in writing. Information, offers, images and descriptions of our online offer or the print media are non-binding. Misprints, technical developments and errors are reserved.

2. Prices
The price basis of all products from VF-Feintechnik GmbH are the offers or order confirmations. Individual price lists lose their validity with the publication of these terms and conditions. The prices of the individual customer groups such as end customers, specialist dealers or wholesalers are only visible in the order confirmation or pre-invoice. Please submit a request in writing or by email. VF-Feintechnik GmbH reserves the right to change prices at short notice or to pass on changed prices of our suppliers.
In this case the customer has the right to withdraw from his order within one week. The prices communicated in the order confirmation or advance invoice are binding. The prices are shown including the currently applicable German sales tax (currently 19%).

3. Deliveries
VF-Feintechnik GmbH delivers by DPD in the standard case. If you prefer a different shipping method, please let us know in advance.
Orders over 30 kg weight are delivered by a forwarding agency. We can only accept collection by a freight forwarder commissioned by the customer within the European Union. The customer must indicate this in good time beforehand. The transfer of goods occurs when the goods are made available in our quarantine warehouse. Invoicing takes place from the time of the transfer of goods.
If an article is not available, we will notify you immediately. VF-Feintechnik GmbH is not responsible for any delays in delivery caused by default on the part of the supplier. VF-Feintechnik GmbH is entitled to deliver and invoice in part at any time.

4. Payment methods
The following payment methods are available: advance payment or invoice. We deliver to new customers and customers outside of Germany in advance. Prepayment customers who pay by bank transfer will receive the necessary bank details with the advance invoice. You can also see the possible delivery time there. We also supply regular customers within Germany by invoice. Should you make a transfer, all bank charges are at your expense.
Paper-based payment media such as B. Checks etc. cannot be processed and must be rejected.

5. Payment terms
The ordered goods are fully owned by VF-Feintechnik GmbH until all outstanding debts of the customer have been settled. Payments are due free of charge and free of charge in accordance with the payment term. These terms and conditions are deemed to have been accepted at the latest when the goods or services are received. The payment term begins with the delivery of the goods by VF-Feintechnik GmbH. If goods are made available for collection, the transfer of ownership and the start of the payment term are made when the customer is informed that the goods are ready for collection. The customer gives his consent to this with his order.

Default in payment occurs when the payment term has been exceeded, no later than 30 days after delivery of the goods. If the payment term is exceeded, all discounts, bonuses and perks that have been granted expire.
A reminder is not absolutely necessary in order to be able to assert claims on the part of VF-Feintechnik GmbH. If the payment term is exceeded, we ask you to settle the claims as follows:
Payment reminder: goodwill
1st reminder: reminder in writing, reminder fee 10 €, net
2nd reminder: reminder in writing and / or by telephone, reminder fee, 18 €, net
3. Reminder: Obtaining a reminder notice, reminder fee according to expenditure or fee statutes.
VF-Feintechnik GmbH charges an administration and bank fee of € 5.00 net (plus 19% VAT) when debiting direct debits and repaying double transfers.
Transaction fees from abroad are not accepted. If this means that the entire invoice amount has not been paid, the difference will be requested. Should you shorten your bills on your own initiative, you will be charged for the additional work involved in the form of reminder fees and the remaining amount will be demanded by all authorities.

6. Shipping costs
In order to enable a simple and transparent determination of the shipping costs for our customers, VF-Feintechnik GmbH refrains from listing costs for the logistics portion, storage or even fuel surcharges separately. These are already included in our shipping costs.

6.1 Shipping to end customers
All goods are insured with an insurance value of 520 euros. A higher insurance value is possible on request and at an additional cost.
Shipping by express is also possible and will be charged at an expense. Please indicate this when ordering.

6.1.1 Standard shipping within Germany:
The dispatch of goods in this zone costs a flat rate of 17.50 euros net per package up to 31.5 kg and is carried out by DPD. All shipments weighing more than 31.5 kg are declared as bulky goods and billed at cost.

6.1.2 Standard shipping within the EU, outside Germany:
The dispatch of goods in this zone is calculated according to EU zone tariffs and expenses.

6.1.3 Standard shipping worldwide, outside the EU:
The dispatch of goods in this zone will be charged according to expenditure.

6.2 Shipping to business customers:
We usually deliver to business customers via DPD. The shipping costs are calculated per package with an insurance value of € 520. A higher insurance value is possible on request for a surcharge.
The conditions are identical to those under 6.1. mentioned.

6.3 Shipping by forwarding agent
If VF-Feintechnik GmbH is the freight carrier (national and international), deliveries by forwarding agent are generally insured to the amount of the net value of the goods. The insurance costs incurred are shown separately in the invoice.

6.4 Packaging Ordinance
In accordance with the provisions of the Packaging Ordinance, we are obliged to take back packaging of our products that do not bear the symbol of a system of comprehensive disposal (such as the "Green Dot" of Duales System Deutschland AG) and to ensure that it is reused or disposed of.
For further clarification on the return of such products, please contact us (phone: +49 (0) 9383 90318-0, sales@vf-feintechnik.de). We will then name a communal collection point or a disposal company in your area that will receive the packaging free of charge. If this is not possible, you can send the packaging to us (VF-Feintechnik GmbH, Untere Brunnengasse 3, 97353 Wiesentheid). We reuse the packaging or dispose of it in accordance with the provisions of the Packaging Ordinance.

7. Export
We export worldwide. Payment is made in advance (BIC, SWIFT). We charge foreign orders within the EU VAT-free if the customer provided the VAT ID number with the order. If we do not have the VAT ID number, the VAT cannot be deducted. Complaints for this reason cannot be accepted. VF-Feintechnik GmbH, Untere Brunnengasse 3, 97353 Wiesentheid reserves the right to recalculate import duties, agent fees and country-specific sales taxes. Upon request, we will take over the formalities for creating the export declaration for our customers. We charge 15 euros plus VAT for this service. Deliveries by DPD to the so-called EFTA countries (Iceland, Liechtenstein, Norway, Switzerland) incur an export fee of 24 euros net.

8. Cancellation policy
Right of withdrawal
Valid for transactions for exclusively private purposes with natural persons.
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods. (In the case of partial deliveries: the cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the last partial shipment or the last piece.

In order to exercise your right of revocation, you must inform us (VF-Feintechnik GmbH, Untere Brunnengasse 3, 97353 Wiesentheid, phone: 09383 90318-0, email: sales (at) vf-feintechnik.de) by means of a clear declaration (e.g. by post sent letter, fax or e-mail) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal
If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
You bear the direct costs of returning the goods.

Failure to have the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the consumer's personal needs.

8.1 Return of goods
VF-Feintechnik GmbH reserves the right to withhold or demand a processing fee of 10% of the value of the goods if the goods are returned after the withdrawal period has expired.

9. Repairs, warranty
For defects or damage that can be traced back to manufacture, we grant end customers free error correction through replacement or repair for a period of 24 months from the date of purchase. From 6 months after the purchase, the customer is responsible for providing evidence of the defect in accordance with Section 437 of the German Civil Code (BGB). We naturally offer a repair service for our products.

Please note:
Every unsolicited repair is initially charged with a flat-rate inspection fee of EUR 39 (excluding 19% VAT). In the event of a guarantee, this amount will of course be credited back.

We would be happy to receive a brief description of the error that is as meaningful as possible. The product is examined on the basis of a flat-rate repair fee of EUR 117.00 including VAT. Additional expenses and material costs may be shown separately. As a matter of principle, we only accept repairs if we refuse any warranty or guarantee functions. Repairs, the guarantee of which we acknowledge, are of course free of charge.

Please always enclose a copy of the purchase receipt with such repairs. Damage caused by overvoltage, lightning strikes, polarity reversal or improper connection, the action of brute force, opening the device and removing the serial number are fundamentally excluded from the guarantee. No guarantee can be provided for claims that cannot be clearly substantiated.

We only accept warranties from our direct partners (customers). We would like to point out that in the event of a guarantee, the product must be returned to us, as only here (main plant) can a corresponding check and correction be carried out for guarantee purposes. Unless explicitly agreed otherwise, the sale takes place with the proviso that the buyer or dealer bears the costs for any on-site maintenance work at the resale location. We expressly point out that our complex mechanical units must be tested prior to dispatch and installation. We are happy to support you with all questions relating to the test process.

10. Notification of defects
In the event of a notification of defects made in good time, the customer can request supplementary performance (removal of the defect or delivery of a defect-free item). If two attempts at supplementary performance are unsuccessful (failed supplementary performance) or if we refuse supplementary performance or if supplementary performance is unreasonable, the customer can withdraw from the contract or reduce the purchase price or demand compensation instead of performance. The customer is obliged to give us the necessary time and opportunity for subsequent performance. If the dismantling and installation of the goods delivered by us is also owed within the scope of the guarantee, we have the option of doing this ourselves or having a third party do it. The removal and installation costs are limited to 3 times the value of the goods.
No guarantee is given for impairment of the delivery item due to natural wear and tear, damage after the transfer of risk or improper handling.
Our liability expires if the customer himself or a third party has reworked and made changes to our delivery without our prior consent, or if parts that have not been delivered or approved by us have been used.

10.1 Goodwill return
If the contract is properly fulfilled, we are not obliged to take back goods. Should this happen in individual cases out of goodwill, the following conditions apply:
a) The goods are in their original packaging and labeled in an identifiable manner and are technically and visually in perfect condition.
b) The net value of the return is at least EUR 100.00 excluding VAT and relates to the total value of a return.
c) The goods have demonstrably been obtained from us within the last 6 months (order confirmation, delivery note, invoice).
d) Timely written notification of the return with agreement of the conditions has been made.
e) Re-storage costs will be charged depending on the value.
f) Customer-specific devices are generally not taken back.

10.2 Freight costs in the case of a goodwill return
If we are willing to take back goods as a gesture of goodwill, the returns must be reported to us and carried out by the customer at the customer's expense.

11. Unsolicited Submissions
We cannot guarantee any unsolicited documents, manuscripts, records or devices sent in. If the item is damaged or lost despite careful handling, VF-Feintechnik GmbH is not liable for this.

12. Take-back of old electrical devices
According to the Electrical and Electronic Equipment Act (ElektroG), we are obliged to take back old electrical equipment free of charge. If you would like to make use of this, you can either return your old device to us on site or send it in by parcel.

13. Liability
  1. The customer's claims for damages or reimbursement of wasted expenses against the seller are based outside of warranty law regardless of the legal nature of the claim according to these provisions.
  2. The seller's liability is excluded - for whatever legal reasons - unless the cause of the damage is based on intent and / or gross negligence on the part of the seller, his employees, his representatives or his vicarious agents. Insofar as the seller's liability is excluded or limited, this also applies to the personal liability of employees, representatives or vicarious agents of the seller. The seller's liability under the Product Liability Act remains unaffected (Section 14 ProdHG).
  3. The seller is liable in accordance with the statutory provisions for damage resulting from injury to life, limb or health based on an intentional, grossly negligent or negligent breach of duty by the seller or a legal representative or vicarious agent of the seller.
  4. If the seller negligently breaches an essential contractual obligation, i.e. an obligation the observance of which is of particular importance for the achievement of the contractual purpose (essential contractual obligation or cardinal obligation), liability is for the typically occurring damage, i.e. for such damage as it occurs must typically be expected within the framework of the contract. An essential contractual or cardinal obligation in the aforementioned sense is one whose fulfillment enables the proper execution of this contract in the first place and on whose compliance the customer regularly trusts and may rely.
  5. According to the current state of technology, data communication via the Internet cannot be guaranteed to be error-free and / or available at all times. In this respect, the seller is not liable for the constant or uninterrupted availability of the website and the services offered there.
  6. Insofar as the Internet offers refer or link to the websites of third parties, no guarantee or liability is assumed for the correctness or completeness of the content and the data security of these websites. Since the seller has no influence on compliance with data protection regulations by third parties, the customer should check the data protection declarations offered separately.
14. Place of jurisdiction
The law of the Federal Republic of Germany. The place of jurisdiction is Lippstadt.

15. Data storage and data protection
Only the data protection regulations of the data protection declaration on the website www.vf-feintechnik.de apply.

16. Final provision
The total or partial ineffectiveness of one of the above conditions does not affect the validity of the remaining terms and conditions. In this case, a formulation is sought that corresponds as closely as possible to the intent of the original text. Other purchasing conditions (sent or enclosed) than ours do not apply. Special, other conditions that conflict with our general terms and conditions only apply if we have expressly agreed to them in writing.
